Continua Health Alliance (“Continua”) takes your privacy very seriously. This notice describes our privacy policy solely applicable to information collected on the Site. By visiting this Site, you are accepting the policies described in this Privacy Policy.

The purpose of this Site is to provide users with information regarding Continua, its objectives, activities, members and deliverables. Specifically, this Site attempts to provide information about the scope, objectives, deliverables and membership of Continua. It also attempts to provide recent and part news about Continua and access to specifications developed by Continua. The Site also provides a mechanism for organizations to join Continua. The Site is governed by the Terms of Use [Provide Link to Terms of Use here.], which includes this Privacy Policy.

What information we collect: Continua may ask for and collect personally identifiable information from you at certain points throughout the Site. Depending on the information and/or services you request, we may ask for information such as your name, e-mail address, company name, title, address, phone and fax number, and similar information (“Personal Information”). In general, you can visit Continua's Web pages without telling us who you are or revealing any personal information about yourself.

In addition to the information you knowingly provide us, we keep track of the domains and IP numbers from which people visit us. We also collect Site usage statistics such as Web browser types and page requests and track users' movements. This data is not personally identifiable and is used to more efficiently operate our business, prepare for network load demands, promote the services and administer the Site. To the extent this information is associated with a particular user, such information will be considered personally identifiable information and will be protected accordingly.

How we collect information: In addition to the information gathered as described above, there is a technology called "cookies" that can be used to provide you with tailored information from a Web site. A cookie is an element of data that a Web site can send to your browser, which may then store it on your system. To respond to your requests or provide you further information about Continua, including membership opportunities, new developments and communications from Continua members about Continua-related products or services.
To provide you with personalized content.
For members of Continua to:

list member company names in a public Web site directory
create contact lists in a members-only area to permit working group members to contact each other
permit anyone affiliated with a member to have their contact information made available in a members-only area

To give our Site developers information that may be useful for developing new features and products for customers.
To improve the content and navigability of the Site.
To alert you to new Site features.
If required to do so by law, court order or other government or law enforcement authority or regulatory agency; when we believe in good faith that disclosing this information is necessary or advisable, including, for example, to protect the rights, property, or safety of Continua, our members, users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Continua will not rent, lease or sell your Personal Information to third parties.

With whom we share your Personal Information: Continua will not disclose your personally identifiable information to any company or individual not a member of Continua unless it is: (i) at your request, (ii) to outsource one or more of the functions described in the previous section, or (iii) with the proper authorities in response to a legal order or official request.

Consent for cross-border transfer of information: Continua is a business alliance of companies operating globally. Please note that while the Site is located in the United States, data collected on the Site may be transferred to, and stored or processed in, other countries, including countries where Continua members are located. Laws of these other countries may not be the same as the laws regulating the use and transfer of personal data in your country. By entering your personal information on this Site, you are consenting to the transfer of that information to the United States or to other countries for the purposes described in this Privacy Policy Statement.

Children: The Site is not directed to children. We do not intend to collect personal information from anyone we know to be under 13 years of age.

Linking to other sites: The Site may contain links to third party Web sites. Continua is not responsible for the privacy practices, security or the content of such Web sites. You are encouraged to review the privacy policies of the Web sites you visit.

How you can decide what communications you will receive: You may opt-out from Continua Public Mail Lists if you do not wish to receive further communications from Continua. We will use reasonable efforts to process any change you make as promptly as possible.

How you can view or update your personal information: To ensure that you have as much control over your personally identifiable information as possible, we allow you to view, update, revise or delete the information you provide by e-mailing us at admin@Continuaalliance.org. We will use reasonable efforts to process any change you make, or your request for deletion, as promptly as possible.

How we protect information: Continua attempts to protect against the loss, misuse and alteration of your personal information. We have a strict internal security policy that limits access to production systems and personal information only to authorized personnel. Our servers are protected by reasonable physical and electronic security. Your privacy is very important to us, but due to the existing legal, regulatory and security environment, we cannot fully ensure that your private communications and other Personal Information will not be disclosed to third parties. Under certain circumstances, the government or third parties may lawfully or unlawfully intercept or access transmissions or private communications. Additionally, in the unlikely event we need to investigate or resolve possible problems or inquiries, we may disclose any information about you to private entities, law enforcement or other governmental officials as we, in our sole discretion, believe necessary and/or appropriate. Though we make every effort to preserve your privacy, we may also need to disclose Personal Information when required by law wherein we have a good-faith belief such action is necessary to comply with a current judicial proceeding, a court order or legal process served on this Site.

Privacy Policy Changes: Due to the constantly changing nature of the Internet, we reserve the right to change, update or modify this policy at any time and will post any new privacy policy here. Any such change, update or modification will be effective immediately upon posting on the Site. The new policy will apply to all current and past users of the Site and will replace any prior policies that are inconsistent. Continua will notify users via e-mail of material changes to the privacy policy as well as post the changes to the Web site.

Use of the Site

Within this Site, Continua provides you access to a variety of resources including, but not limited to, membership information, press releases and other general information about Continua (“Resources”). The Resources are subject to these Terms. Continua reserves the right to update these Terms at any time without notice to you.

Conditions of your use of the Site

As conditions to your use of this Site, you agree that you will not:

1. Modify, copy, distribute, transmit, display, perform, reproduce, publish, broadcast, license, create derivative works from, transfer or sell any information, software, products or services obtained from the Site;

2. Use the Site for any unlawful purpose;

3. Use any of the Resources in a manner that could damage, disable, overburden or impair any Continua server or the networks connected to any Continua server;

4. Attempt to gain unauthorized access to any of the Resources through hacking, password mining or other means;

5. Obtain or attempt to obtain any materials or information not intentionally made available through the Resources;

6. Use any robot, spider, other automatic device or manual process to monitor, deep link with or copy the Site’s web pages or any of the Site’s content; and

7. Upload files, other than as provided by the Resources, that contain viruses, Trojan horses, worms, time bombs and cancelbots, corrupted files or any other similar software or programs that may damage the operation of the Site or another computer.

Privacy Policy

Continua will only use and disclose your information in accordance with the Privacy Policy Statement available on this Site. This Privacy Policy Statement is part of the Terms.

Submissions

You agree that any information, feedback, questions, comments and related materials that you provide to Continua in connection with this Site (“Submissions”) will be provided to Continua on a non-confidential and non-proprietary basis. The Submissions will become and remain the property of Continua. Continua shall have no obligations to you of any kind with respect to any Submissions and shall be free to reproduce, use, disclose and/or distribute any Submissions for any purpose whatsoever, without limitation. You also agree that Continua shall be free to use any ideas, concepts or techniques embodied in the Submissions for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products or services incorporating such ideas, concepts or techniques.

User Registration, User IDs and Passwords

If any of the Resources require you to register on this Site, you must complete the registration by providing current, complete and accurate information as prompted by the registration form. You may also receive a Continua user ID and password. You are entirely responsible for protecting and maintaining the confidentiality of your user ID and password as well as all activities that occur under your account. You agree to immediately notify Continua of any unauthorized use of your account. Continua will not be liable for any loss that you may incur as a result of an unauthorized use of your user ID or password. However, you could be held liable for losses incurred by Continua due to an improper use of your user ID or password. You may not use any other person or entity’s user ID or password at any time.

Termination

Notwithstanding any of these Terms, Continua reserves the right, without notice and in its sole discretion, to terminate your use of this Site and to block or prevent further access to and use of this Site by you.

THE SITE, THE RESOURCES AND THE MATERIALS IN THE SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Severability and Non-waiver

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and the enforceability of the remaining provisions. The failure of Continua to insist upon or enforce strict performance of any of these provisions or to exercise any rights or remedies under these Terms will not be construed as a wavier or relinquishment to any extent of Continua’s right to assert or rely upon any such provisions, rights or remedies in that or any other instance; rather the same will be and remain in full force and effect.
